Cold Email: Regulated under CAN-SPAM Act, not TCPA. Must include proper disclosures, a valid postal address, and a clear opt-out mechanism. Purchasing Leads: Allowed only if the leads have provided explicit, one-to-one consent for your specific business.
Cold Text Messages: Requires prior express written consent for your specific business. Cold Ringless Voicemail Drops: Classified as a "call" under TCPA and requires explicit consent. Cold Power Dialing Calls: Automated dialing without prior consent is prohibited.
Engaging in prohibited activities under the TCPA can result in significant financial penalties, including:
Standard Violations: Fines of up to $500 per unauthorized call or message. Willful or Knowing Violations: Fines of up to $1,500 per violation if determined to be intentional.
By using the Platform, you agree to adhere to these guidelines and understand the risks of non-compliance.
By using Business Toolbox, you agree:
To operate your business practices in compliance with applicable laws and regulations, including but not limited to the FCC TCPA rules and the CAN-SPAM Act. To indemnify and hold Business Toolbox harmless from any claims, damages, or penalties arising from your activities. Not to use the Platform for any illegal, unethical, or prohibited purposes. To ensure that all data collected and used complies with relevant data protection laws, such as GDPR and CCPA, where applicable.
To the maximum extent permitted by law, Business Toolbox shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:
The use or inability to use the Platform. Unauthorized access to or alteration of your transmissions or data. Actions or practices conducted by users of the Platform. Any other matter relating to the Platform.
You agree to defend, indemnify, and hold harmless Business Toolbox, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
Your use of and access to the Platform. Your violation of any term of these Terms and Conditions. Your violation of any third-party right, including without limitation any copyright, property, or privacy right. Any claim that your use of the Platform caused damage to a third party.
